5. Services
Descriptions of services on this website are provided for general information. Although reasonable efforts are made to ensure accuracy, services may change without prior notice. Any quotations, estimates or timelines are indicative unless expressly agreed in writing.
6. Orders
An order submitted through the website constitutes an offer to purchase services. A contract is formed only when we confirm acceptance of your order in writing or by email. We reserve the right to decline any order, including where:
-
information supplied is incomplete;
-
payment cannot be processed;
-
the requested service is unavailable;
-
there is a pricing or technical error.
7. Prices
Prices displayed on the website are shown in the stated currency. Unless otherwise indicated:
-
prices include applicable taxes where legally required;
-
additional costs (if any) will be displayed on the final invoice all clients should receive.
We reserve the right to amend prices at any time before an order is accepted.
8. Payment
Payment methods available are displayed during the booking process. Appointments are scheduled through Calendly, which is integrated with certified third-party payment processors, including Stripe and PayPal. We do not collect, process or store your full payment card details. Calendly stores only the last four digits of your payment card, the card type and the expiry date for record-keeping purposes. Full payment details are processed securely by Stripe or PayPal in accordance with their own privacy policies. Where payment is made by bank transfer, we may retain your bank account details where necessary for payment reconciliation, accounting and compliance with applicable legal obligations. Payment is due as specified before services commence unless otherwise agreed in writing. Late payments may result in suspension of services until payment has been received.
9. Performance of Services
Services will be delivered within the timeframe agreed with the customer. Delivery dates are estimates unless expressly agreed as fixed deadlines. The customer agrees to provide all information reasonably required to enable performance of the services. Delays caused by the customer may extend delivery times.
10. Consumer Right of Withdrawal
If you are a consumer residing in the European Economic Area, you may have a statutory right to withdraw from a distance contract within 14 days in accordance with applicable consumer protection legislation. However, where you expressly request that the service begins during the withdrawal period and acknowledge that your right of withdrawal may be lost once the service has been fully performed, you agree to the immediate commencement of the service. If the service has been partially performed before withdrawal, you may be required to pay a proportionate amount for the services already provided, as permitted by applicable law. Nothing in these Terms limits or excludes your mandatory statutory consumer rights.
11. Cancellations
Customers may request cancellation before work has commenced. Once work has begun, cancellation requests will be considered individually and fees may apply for work already completed. Refunds, when and where applicable, will be processed using the original payment method.
12. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights relating to this website, including text, graphics, logos, branding and content, remain the property of Abigail Mokrá and/or the relevant licensors. No licence or ownership rights are transferred except as expressly stated. Where services involve the creation of deliverables, ownership will transfer only where expressly agreed and after full payment has been received.
13. Customer Content
Where customers provide information, documents or materials, they warrant that they have the necessary rights to do so. The customer remains responsible for the legality, accuracy and content of all submitted materials.
14. Acceptable Use
You agree not to use the website or our services for unlawful, fraudulent, defamatory or abusive purposes. We reserve the right to refuse or terminate services where such use is reasonably suspected.
15. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation; or
-
any statutory rights that cannot legally be excluded.
Subject to the above, and to the fullest extent permitted by law:
-
this website is provided on an "as available" basis;
-
we shall not be liable for indirect, incidental or consequential losses;
-
our total liability arising from any contract shall not exceed the amount paid by the customer for the relevant service.
